ANNEX D

1. Justification for the choice of the negotiated procedure without prior publication of a call for competition in accordance with Article 32 of Directive 2014/24/EU

No tenders or no suitable tenders/requests to participate in response to: Not Provided

The products involved are manufactured purely for the purpose of research, experiment, study or development under the conditions stated in the directive (for supplies only): No

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the directive: No

Additional deliveries by the original supplier ordered under the strict conditions stated in the directive: No

Procurement of supplies quoted and purchased on a commodity market: No

Purchase of supplies or services on particularly advantageous terms: No

3. Explanation
Absolute geomagnetic observatories meeting the stated INTERMAGNET quality standards number less than 130 stations worldwide, hence there are a limited number of commercial suppliers of instrumentation that meet this specialist market and therefore the technical requirement.

Aside from Lemi LLC, the only alternative commercial supplier globally for absolute observatory vector fluxgate magnetometers is the Danish Technical University. Their FGE magnetometer has been the standard observatory instrument for the last 20 years, however it does not meet the essential requirements in the above specification for modern observatories. The supplier (contact: Lars Pedersen, lawp@space.dtu.dk) has stated (by email), “the FGM-FGE dos’nt fullfill the Intermagnet standard for the noise level in the pass band 8mHz-0.2Hz, where the noise is around 40pT rms”. This confirms in-house testing of the FGE magnetometer (http://iguonline.in/journal/Spl2_aiga_web%20files/paper3.pdf).

For the reason that competition is absent for technical reasons, Lemi LLC is the only supplier capable of meeting the required specification.
